1. Introduction
Welcome to Easy Phones LTD (“Easy Phones”, “we”, “us”, or “our”).
These Terms of Service (“Terms”) govern your use of our website, platform, services, and your purchase of smartphones and related products from Easy Phones.
By accessing our services, submitting an application, purchasing a device, entering into a payment plan, or otherwise using our services, you agree to be bound by these Terms.
If you do not agree with these Terms, you should not use our services.
2. Our Services
Easy Phones provides smartphones and related products to customers and may facilitate access to flexible payment or financing arrangements through third-party financing partners.
Depending on the applicable arrangement, customers may be required to:
- Make an initial or down payment;
- Make daily, weekly, monthly, or other agreed payments;
- Complete an application and verification process;
- Provide information required for customer verification;
- Comply with the terms of any applicable financing agreement.
Where financing is provided by a third-party financing partner, the financing arrangement may be subject to the partner’s separate terms and conditions.
3. Eligibility
To use our services, you must:
- Be legally capable of entering into a binding agreement;
- Provide accurate and complete information;
- Meet any eligibility requirements applicable to the selected product or financing plan;
- Comply with all applicable laws and regulations.
Easy Phones reserves the right to decline or cancel an order or application where eligibility requirements are not satisfied.
4. Customer Information and Verification
Customers may be required to provide information necessary to process an order or financing application.
You agree that all information provided to Easy Phones or its financing partners will be accurate, complete, and up to date.
We may conduct verification and fraud-prevention checks where necessary and may share relevant information with authorized service providers or financing partners for the purpose of processing your application or transaction.
5. Product Prices and Availability
All product prices are subject to change without prior notice.
Prices displayed or quoted by Easy Phones are based on the information available at the time of purchase and may vary depending on the device, configuration, financing arrangement, promotions, or other applicable charges.
Product availability is not guaranteed until an order has been confirmed by Easy Phones.
We reserve the right to correct pricing, product descriptions, availability information, or other errors where they occur.
6. Orders and Payment
An order becomes confirmed only when Easy Phones has accepted the order and, where applicable, the required initial payment has been received.
Customers are responsible for making all payments according to the agreed payment schedule.
Payment obligations may include:
- Initial/down payment;
- Daily, weekly, or monthly instalments;
- Delivery charges;
- Applicable fees or charges disclosed before purchase.
Customers should ensure that payments are made on or before their agreed due dates.
7. Financing and Third-Party Partners
Where a customer’s purchase is financed by a third-party financing provider, Easy Phones may act as the device seller or dealer while the financing provider manages the financing arrangement.
The financing provider may have separate terms governing:
- Credit approval;
- Repayment schedules;
- Interest or other charges;
- Late payments;
- Device restrictions;
- Default;
- Recovery or repossession;
- Other matters relating to the financing arrangement.
Customers are responsible for reviewing and accepting the applicable financing agreement before completing a financed purchase.
Where there is a conflict between these Terms and a financing agreement concerning the financing relationship, the applicable financing agreement may take precedence.
8. Late Payments and Default
Customers are expected to make payments according to their agreed payment schedule.
Failure to make payments when due may constitute a default under the applicable purchase or financing agreement.
Depending on the applicable agreement, consequences of default may include:
- Late-payment charges where applicable;
- Suspension of certain services;
- Device restrictions;
- Recovery of outstanding amounts;
- Repossession of the financed device where legally permitted;
- Other remedies available under the applicable agreement and Nigerian law.
Easy Phones and/or its financing partner will only exercise remedies permitted by the applicable agreement and law.
9. Delivery
Easy Phones will make reasonable efforts to deliver products to the address or collection point provided by the customer.
Delivery timelines may vary depending on location, product availability, logistics, and other circumstances.
The customer is responsible for providing accurate delivery information and being available to receive the product.
Easy Phones is not responsible for delays caused by circumstances outside our reasonable control, including logistics disruptions, weather, government restrictions, technical failures, or other unforeseen events.
10. Inspection Upon Delivery
Customers are encouraged to inspect their device immediately upon delivery or collection.
Any visible damage, missing accessories, incorrect product, or other delivery-related issue should be reported to Easy Phones as soon as reasonably possible.
Customers may be required to provide photographs, videos, receipts, or other information to support a complaint.
11. Returns and Exchanges
Returns and exchanges are subject to Easy Phones’ applicable return policy.
A product may only be eligible for return or exchange where it meets the applicable conditions communicated to the customer at the time of purchase.
Unless otherwise stated, products must be returned in their original condition and with applicable accessories, packaging, and documentation.
Certain products may not be eligible for return or exchange due to hygiene, activation, usage, financing, or other applicable restrictions.
12. Warranty
Where a device is covered by a manufacturer or authorised warranty, warranty claims will be handled in accordance with the applicable manufacturer’s warranty terms.
The warranty may not cover damage resulting from:
- Accidental damage;
- Liquid or moisture exposure;
- Physical damage;
- Improper use;
- Unauthorised repairs or modifications;
- Negligence;
- Normal wear and tear;
- Software or user-caused issues.
Customers should contact Easy Phones for guidance on how to initiate an applicable warranty claim.
13. Device Ownership
The ownership of a device purchased through a financing arrangement may be subject to the terms of the applicable financing agreement.
Where a financing partner retains an interest in the device until the customer’s payment obligations are completed, the customer’s rights and responsibilities regarding the device will be governed by the applicable agreement.
Customers must not sell, transfer, lease, or otherwise dispose of a financed device where doing so is prohibited by the applicable agreement.
14. Responsible Use
Customers agree not to:
- Use our services for fraudulent or unlawful purposes;
- Provide false or misleading information;
- Attempt to circumvent payment or financing requirements;
- Tamper with device security mechanisms;
- Engage in activities intended to defraud Easy Phones or its financing partners;
- Use our platforms to interfere with or compromise our systems.
We reserve the right to take appropriate action where fraudulent, abusive, or unlawful activity is suspected.
15. Promotions and Discounts
Promotions, discounts, referral offers, and other incentives may be subject to additional terms.
Easy Phones reserves the right to modify, suspend, or discontinue a promotion where permitted by law.
Promotions cannot be combined unless expressly stated otherwise.
16. Intellectual Property
All content appearing on Easy Phones’ website, platform, social media pages, marketing materials, and other official channels, including logos, graphics, text, designs, images, and software, is owned by or licensed to Easy Phones and is protected by applicable intellectual property laws.
You may not reproduce, modify, distribute, or commercially exploit our content without our prior written permission.
17. Privacy and Data Protection
Easy Phones may collect and process customer information necessary to provide our services, process transactions, verify customers, facilitate financing, prevent fraud, provide customer support, and comply with legal obligations.
We will handle personal information in accordance with applicable Nigerian data protection laws and our Privacy Policy.
Where a third-party financing provider is involved, relevant customer information may be shared with that provider as necessary to process and administer the financing arrangement.
18. Limitation of Liability
To the extent permitted by applicable law, Easy Phones will not be liable for indirect, incidental, special, or consequential losses arising from the use of our services.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under Nigerian law.
Our liability relating to a specific product or transaction will, where permitted by law, be limited to the amount paid by the customer for the affected product or transaction.
19. Events Beyond Our Control
Easy Phones will not be responsible for failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control.
These circumstances may include natural disasters, government actions, telecommunications failures, internet outages, strikes, security incidents, transportation disruptions, or other unforeseen events.
20. Changes to These Terms
We may update these Terms from time to time to reflect changes to our services, business practices, legal requirements, or other circumstances.
Updated Terms will become effective when published through our official channels unless a different effective date is stated.
Your continued use of our services after an update constitutes acceptance of the revised Terms.
21. Termination
Easy Phones may suspend or terminate access to its services where a customer:
- Breaches these Terms;
- Provides fraudulent or misleading information;
- Engages in unlawful activity;
- Fails to comply with applicable payment or financing obligations; or
- Otherwise misuses our services.
Termination does not remove any payment or other obligations that accrued before termination.
22. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Federal Republic of Nigeria.
Any dispute arising from these Terms or the use of our services shall be handled in accordance with applicable Nigerian law.
23. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to remain valid and enforceable to the fullest extent permitted by law.
24. Entire Agreement
These Terms, together with any applicable order confirmation, financing agreement, return policy, privacy policy, warranty terms, and other applicable terms communicated to the customer, constitute the agreement governing your use of Easy Phones’ services.
